Long <br />Drvrs~on Dneaor <br />We have received your response to our adequacy concerns regarding the above mentioned <br />revision application. Sun Coal Company did not find regulations or statutory requirements <br />for the items addressed by the Division as deficiencies in the proposal, and therefore <br />requested that the Division approve or deny the revision. We will approve the revision as <br />submitted. Sun Coal Company should, however, be aware of the following. <br />1. We requested that Sun Coal Company document the inspections in the form of a <br />written report and/or map. While the commitment for specific documentation need <br />not be stated in the approved permit application, please be aware that Sun Coal <br />Company must have some means of proof that the required annual rill and gully <br />inspections are being conducted. <br />2. The Division stated that Sun Coal Company should commit to retaining a copy of all <br />rill and gully inspection reports on file with other mine records, and that a copy of the <br />reports must also be submitted to the Division. Rule 5.02.4(1) states that "Copies <br />of all records, reports, inspection materials, or information obtained under these Rules <br />by the Division or Board, except information identified as confidential, shall be <br />immediately available to the public at the Division office and at a convenient place in <br />the area of mining to which the information pertains until at least five years after <br />expiration of the period during which the subject operation is active or is covered by <br />any portion of reclamation bond." Documentation of rill and gully inspections would <br />be subject to this requirement. Since this is a performance standard, and including <br />a commitment to this effect in the permit application package would be duplicative, <br />we will retract our requirement for further revision to the application text. Sun Coal <br />Company will, however, be required to maintain a copy of inspection documentation <br />for public review at a location near the mine and to submit a copy for public review <br />at the Division. <br />
