NOTICE OF PROPOSED DECISION <br />The Colorado Division of Reclamation, Mining and Safety proposes to Approve Technical Revision <br />Application No. 48 (TR-48) for the Bowie No. 2 Mine (Permit No. C-1996-083), submitted by Bowie <br />Resources, LLC (BRL). In Technical Revision No. 48, BRL is proposing to revise the Hubbazd Creek <br />ventilation shaft project that was approved in Technical Revision No. 47. Instead of one 18 foot finished <br />diameter 600 foot deep shaft, BRL is proposing two 10.5 foot finished diameter 500 foot deep shafts. A <br />pit for drilling mud will be needed but it will be reclaimed immediately after drilling. A rockfall <br />protection berm will also be constructed next to the hillside. The modifications to Technical Revision <br />No. 47 that are proposed in Technical Revision No. 48 will result in a reclamation liability reduction of <br />$39,715.00 <br />The Bowie No. 2 Mine is an underground coal mine located in Delta County, approximately 5 miles NE <br />of Paonia, Colorado. Coal interest is Federal and private, and the surface affected is Federal and private <br />land. The permit azea encompasses approximately 5,304.80 acres. <br />This proposed decision is based on a finding that the proposed operation will comply with all <br />requirements of the Colorado Surface Coal Mining Reclamation Act, Section 34-33-101, et seq., C.R.S., <br />and the regulations promulgated thereunder. <br />Copies of the proposed decision, including stipulations, aze on file for public inspection at the Colorado <br />Division of Reclamation, Mining and Safety, Room 215, Centennial Building, 1313 Sherman Street, <br />Denver, Colorado 80203. Persons with an interest that may be adversely affected by the proposed <br />decision may request a formal hearing before the Mined Land Reclamation Boazd on the proposed <br />decision. Such request must be made within ten (10) days of the initial publication of this notice, must be <br />in writing, and must state with reasonable specificity the reasons for the request and the objections to the <br />proposed decision. <br />
