On <br />July 25, 1986 the financial warranty for this permit was cancelled A <br />replacement financial warranty needed to be filed with us as noted in recent <br />correspondence to you. We have not received a replacement financi 1 <br />warranty. Therefore, we have found that there is reason to believ a <br />violation exists to Permit M-86-026 and the Law and have scheduled this matter <br />before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the October 25-26, 198 Board <br />meeting for consideration of violation. The hearing will be held n Room 110 <br />of 1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m, o as soon <br />thereafter as the matter can be considered and you will have the o portunity <br />to be represented and heard. It will be reiterated that there is eason to <br />believe that you are in violation of the permit and the law, speci ically the <br />following provision: <br />Failure to maintain a financial warranty in good standing f¢r the life <br />of the permit as required by 34-32-117(6), C.R.S. <br />If the Board finds a violation at this hearing, it may issue a cea~e and <br />desist order, assess a civil penalty in the amount of $100.00 to $ ,000.00 for <br />each day of violation or order the permit he suspended, modifed, o revoked. <br />IF YOU WANT TO AVOID THESE CONSEQUENCES, PLEASE SUBMIT A REPLACEMEI <br />WARRANTY AS DESCRIBED IN 34-32-117, C.R.S., BY r~ 1~9, 1986. <br />If you have any questions, please contact Diana L. node.G-c.,-~ <br />Si.n4erely,, ~ ~ %, <br />' FZT{IVID C.
