<br />III. Comments - Com oli ante <br />Below are particular issues ~•;it`~ regard to any of the above compliance items. Enforcement <br />actions resulting from Failure to comply Frith the Act, Rules and P.egulations, and the permit <br />also are identified below. <br />Availability of Records (5.02.4) <br />The only document which was not available at the office ~.~as tl~e permit document. A copy of <br />this document (interim permit no. 78-45) should be kept at the office at all times. The <br />Rockcastle Company should contact the Division if a new copy is needed. <br />Roads (9.03 <br />The haul road to pit no. 4 is nearly complete. Only a few additional ditch relief culverts need <br />to be installed. Bob Sherman indicated that a clay cap material will be placed on the road <br />during final construction. It is not clear whether the road has been constructed according to <br />the approved plan. Inspection by the Divisions geotechnical engineer may be required for <br />verification of design. Also, the structure should be certified upon completion and during <br />construction phases. <br />Road outslopes have been topsoiled and seeded. This is a violation cf stipulation no. 2 which <br />was a condition of the approval for the haul road to pit no. 4 as communicated to Gilliam <br />Heiden in a Setter dated August 31, 1981. At that time the Division felt that topsoiling out- <br />slopes directly after road construction could result in contamination of soils due to fugitive <br />coal dust from passing trucks. It was felt that it would be better to stockpile and protect <br />the topsoil until after cessation of mining in pit no. 4. Notice of Voila ti on 82-48 for <br />failure to follow an approved mine plan is beiny issued. <br />Support Facilities (4.09) <br />The portable shop area will soon be moved from the yard near pit no. 5 to an area closer to <br />pit no. 4. Rockc.astle should submit a map showing the new location of the shop area. <br />Hydrologic Balance (9.05) <br />The diversion ditch has been installed around the pit no. 4. Although the sediment pond has not <br />yet been completed, the pit itself will act sufficiently as interim sediment control until the <br />first cut progresses to the point that the pond can be constructed. <br />All ditches have been cleaned and straw filters have been replaced. <br />Slides and Other Da ma ye (4.12) <br />The slide area east of Pit no. 2 has been completely backfilled, regraded and seeded. <br />Additionally, the diversion ditch which probably contributed to saturation of the fill and the <br />resulting failure has been removed. <br />Backfilling and Grading (4.14) <br />Pit no S should be completely minecY out in early November, 1982. In order.to meet the require- <br />ments for contemporareous reclamation, the pit must be bacY.filled and graded by Clay, 1982. <br />If there is any reason why this may not be feasible the operator should request a delay in <br />contemporaneous reclamation in accordance with Rule 4.I 3. <br />
