Peak Project Management, LLC
34115 County Road 20.8
Trinidad, CO 81082
Telephone/Fax: (7'19) 848-4975
Cell: (719) 859-011 ~
e-mail: ron4;hompson~sensonics.org
December 19, 2006
Mr. Ken[ Gorham
Division of Reclamation, Mining and Safety
1313 Sherman Street, Room 215
Denver, CO 80203
Re: New Elk Mine Permit No.: C-81-012
CV-2006-003
Dear Mr. Gorham:
- -- - - - -- R~~EIV_ F~-
OEC 2 U 2006
Div nin of Eec'amafioq.
9 and Safety
Picketwire Processing hereby requests that the closwe order issued as a result of a delay in abating the
above violation for failure to post adequate bond be vacated. As noted in the violation assessment
conference, Picketwire Processing and New Elk Coal Company were actively pursuing an adequate letter of
credit and/or sucety bond to comply with the Bonding requirement for the New Elk Mine prior to and after
issuance of the violation.
Subsequent to the issuance of the violation, both companies and potential bonding agents kept the Division
updated relative to progress regarding the issuance of the required bond. Regulations permit the Division to
issue extensions, if warranted, of up to ninety days for abatement of a violation. Given the diligent pursuit
of adequate bonding by PPLLC and NECC and the submittal of adequate bonding to the Division prior to
the end of the ninety day period, the closwe order should be vacated.
Yow consideration of this request is appreciated. If you have any questions, please contact me.
Sincerely,
~~'''
Ron Thompson
Agent
