Some inconsistencies in the approved design <br />and the actual constructed pond were noted. The following concerns were identified during the <br />initial review: <br />1. Exhibit 13-7 (as approved February 03, 1992) stated that the inlet to the pond <br />would be armored with riprap or excavated into bedrock. It was determined <br />during Meld inspection of the pond that the inlet was not excavated into bedrock. <br />The newly submitted Exhibit 13-7A does not show an armored inlet channel. If <br />the channel will not be protected, please provide the Division with a <br />demonstration that runoff will enter the pond at nonerosive velocities. <br />2. Page 13-5-10 of the permit application package states that "The final ponding <br />capacity will be constructed to contain approximately four years of storage." <br />Peabody Coal Company originally estimated sediment loading to the pond would <br />be 2.27 ac-ft per year (page 13-5-6 of PAP), and that the required sediment <br />storage capacity (four years) would be 9.4 ac-ft. Page 13-SA-5 of the TR 17 <br />submittal states "The amount of initial sediment storage is 3.01 ac-ft. The <br />cleanout level is 60 percent of capacity. Therefore, when the sediment volume <br />reaches 2.40 ac-ft (elevation 7081.1), the pond will be cleaned out." The <br />designated cleanout point of 2.40 ac-ft appears to be an error, as 60 percent of <br />3.01 ac-ft is 1.80 ac-ft. The pond, as constructed, will require more than one <br />cleaning annually. Division policy considers a minimum of three years sediment <br />
