Wakher <br />Assistant State SnpeMS07 Executive Director <br />Fish and Wildlife Enhancement Ronaia w. cottony <br />Division Director <br />U.S. Fish and Wildlife Service <br />764 Horizon Drive, South Annex A <br />Grattd Junction, CO 81506-3946 <br />Re: Bowie No. 2 Mine (Permit No. C-1996-083) <br />Technical Revision Application No. 26 (TR-26) <br />Clarification Agent for Pond C Discharge <br />Deaz Sir or Madam: <br />The Division of Minerals and Geology hereby issues notice, in accordance with Title 34, Article 33, Section 116, <br />Paragraph 4, of the Colorado Revised Statutes, that on June 2, 2003, an application to revise coal mining <br />operations at the Bowie No. 2 Mine was considered complete for the purposes of filing. The revision was <br />submitted by Bowie Resources Limited. All review and comment periods as provided in the Act and the <br />Regulations initiate from this date of filing. <br />Bowie Resowces is requesting permission to use a clarification agent to ensure that the dischazge from Pond C <br />will be in compliance with water quality requirements. The clarification agent is NALCO 7880, which contains <br />aluminlun chloride hydroxide and calcium chloride. The clarified water would flow from Pond C into the Deer <br />Tmil Ditch and the Fire Mountain Canal. The Colorado Water Quality Control Division has approved the use of <br />the clarification agent for this purpose at the Bowie No. 2 Mine. <br />The underground coal mining operation is on land located approximately 5 miles northeast of Paonia, Colorado. <br />The permit azea is further described as follows: <br />Portions of Sections 2, 3, 4, 5, 8, 9, 10, 11, 14, 15, 16, and 22, Township 13 South, Range 91 West of the 6th P.M. <br />Portions of Sections 33 and 34, Township 12 South, Range 91 West of the 6th P.M. <br />The above-mentioned tracts of land are shown on USGS 7.5 minute Quadrangle map of Bowie. <br />Because the above referenced technical revision application would alter previously approved permit conditions or <br />mitigation measwes, we are requesting yow agency's evaluation of the potential for impacts to threatened or <br />endangered species of plants or animals, or wildlife species otherwise protected by federal law. <br />In order for us to approve this revision, we aze required to make a finding that "the activities would not affect the <br />continued existence of endangered or threatened species or result in the destruction or adverse modification of <br />their critical habitats as determined under the Endangered Species Act of 1973...."
