("Colowyo"). That ability rests solely in Kennecott Colorado <br />Coal Company as general partner. Nor do Gracoal or Gracoal II either own the coal to be <br />mined by Colowyo (Colowyo itself is the owner or lessee of all coal to be mined), or have a <br />lease, sublease or other contract with Colowyo that gives Gracoal or Gracoal II the right to <br />receive the coal after mining. <br />
