Long, Director <br />Division of Minerals and Geology <br />Department of Natural Resources <br />215 Centennial Building <br />1313 Sherman Street <br />Denver, Colorado 80203 <br />e <br />Re: Proposed Decision to Approve Phase I Bond Release, 720 Pit, <br />Kerr Coal Company, Marr Mine, Permit No. C-80-006. <br />Dear Mr. Long: <br />This letter acknowledges the Office of Surface Mining Reclamation and <br />Enforcement's (OSM) receipt and review of the subject June 13, 1995, <br />Proposed Decision. OSM is in agreement with the Proposed Decision. <br />The Colorado Department of Natural Resources, Division of Minerals and <br />Geology (DMG- conducted the required Phase I Bond Release inspection of the <br />Mart Mine, 720 Pit, on June 5, 1995. DMG provided notification of the <br />inspection to OSM's Denver Field Division (DFD) and Albuquerque Field Office <br />(AF01. OSM did not participate in this inspection, but did participate in the <br />initial May 12, 1994, Phase I Bond Release inspection of this site (see OSM <br />5/25/94 Mine-Site Evaluation Inspection Reportl. <br />DFD has reviewed the DMG June 5, 1995, Bond Release Coal Inspection Report <br />and finds that OSM concerns identified on the May 12, 1994, inspection have <br />been remediated through the appropriate permitting actions and implemented in <br />the field. <br />DFD acknowledges that no release of Federal Lands is proposed for the 720 Pit, <br />therefore, no concurrences are necessary from any Federal Land Management <br />Agencies. DMG's Proposed Decision, in accordance with Colorado Rule <br />3.03.1(311d1, indicates that sufficient bond will remain after the Phase 1 Release <br />to complete the approved reclamation plan.
