i. .o <br />i ~"~ <br />J <br />NOV C-93-007 <br />Somerset Mine <br />i <br />This NOV was written for failure to protect salvaged topsoil. <br />HISTORY <br />Two NOV's have been issued to the Somerset Mine during the past <br />twelve months. Those were NOV's C-92-033 and 034, both of which <br />were issued in October, 1992. ~ <br />$100 is assessed for history. <br />SERIOUSNESS <br />Contamination of salvaged topsoil potentially inhibits the <br />likelihood of successful reclamation of the mine. This particular <br />mine operation apparently does not have an over-abundance of <br />salvaged topsoil to work with. With proper abatement, the volume <br />of contaminated topsoil should be minimal. However, degradation of <br />topsoil has a potentially serious impact on the success of future <br />reclamation. <br />$750 is assessed for moderate seriousness. <br />FAULT <br />Coal was stacked on and against a marked topsoil stockpile. This <br />was apparently an intentional act. <br />$1000 is assessed for fault. <br />GOOD FAITH <br />The operator began abatement work during the course of the <br />inspection which resulted in issuance of the NOV. However, the NOV <br />has not been abated as of this date. Therefore, good faith is not <br />applicable at this time. <br />c:\wp51\1r316b <br />
