Hi, Ke11y. Just a note to let you know that Twentymile Coal Company informed
us this morning that it intends to supply the attached notice to all water owners and
users downstream of last week's coal fines slurry spill into Foidel Creek in Routt County.
We informed the company today that the notice appeared adequate, but that we would not be
able to agree or disagree with the statements relative to impacts/potential toxicity.
The company has informed us that it intends to notify those owners and users that utilize
take-outs (alluvial wells, irrigation ditch head-gates, etc) located between the point of
the spill and the confluence of Trout Creek and the Yampa River. The company is in
contact with personnel from DNR's Division of Water Resources office in Steamboat Springs
to develop a mailing/contact list. We have asked the company to provide us with some form
of verification that these notifications have occurred. Please contact me if you have any
questions.

send-out to downstream water users/owners. I am working with Erin Light of
the local office of the Division of Water Resources to develop a mailing
list, and hope to get the notices out tomorrow via registered mail. Please
