<br />and desist order preventing further mining activities outside of the permitted boundaries and <br />ordered the Operator to undertake corrective actions within 180 days of the signed Board <br />orders. The Board orders were signed on January 21, 2005, which gave the Operator until <br />July 20, 2005 to comply. <br />3. The Operator requested, and received, an extension to obtain a Section 112 reclamation <br />permit for the entire site by November 17, 2005. <br />4. The Operator now seeks another extension to April 1, 2006 to convert its Section 110 permit <br />into a Section 112 permit. The Operator submitted a conversion application in a timely <br />manner but the conversion application was considered incomplete due to a discrepancy with <br />the signature page and continued issues concerning site access. The site access issue is <br />complicated by the presence of old mining claims overlapping with site boundaries. <br />Based on the Division's recommendation and the Operator's apparent intent to comply with <br />the Board's corrective actions, it is appropriate to extend the deadline for submittal of a <br />complete Section 112 permit application to April 1, 2006. <br />ORDER <br />Based on the foregoing findings of fact and conclusions of law, the Board hereby orders the <br />Operator to submit a complete Section 112 application by Aprit 1, 2006. <br />DATED this ~'`"~ day of , 2005. <br />FOR THE COLORADO MINED LAND RECLAMATION BOARD <br />Harry J.
