Dear Ms Fay
The Division has received your faxed letter of 8/27/04. In that letter you had requested
additional information to aid you in preparing your exhibits and evidence that is needed
to be provided to all parties by the due date. I contacted you this afternoon and went item
by item and agreed to fax you what we discussed in writing,
1) You asked for a written confirmation of the maximum depth of the pit being 45
feet. RESPONSE: I have enclosed a copy of Exhibit " C" from the original
permit and EXHIBIT "D" From the conversion application. I also informed you
that it would also be part of the condition of the approval.
Z) Response from DOW and SRC. RESPONSE: enclosed in the fax are copies of the
letters you requested.
3) Copies of the SPCC plan from the operator. RESPONSE: As I told you during he
pre-hearing conference, the operator can not place any kind of fuel or solvents
until the quantity of fuel, solvents etc. etc is provided in advance and the design
for the are where these solvents are placed are approved by DMG. It will be part
of the conditional approval of the permit.
4} Hydrologic data related to the existing gravel permit. RESPONSE: At the time of
the 110 approvals in 1991 and during the review of the conversion application did
not feel there would be impacts to ground water so no ground water monitoring
was approved and none will be recommended.
5) A copy of the Storm Water Management permit. RESPONSE: Please contact the
Colorado Deparhnent Of health and Environment for the Storm Water
Management permit.
6) Quantity of Fuel to be stored on site. Response: Please refer to response to item #
3.
