Moms and Anderson: <br />David Berry, the State of Colorado's Coal Resources Program Supervisor, asked me for an <br />informal opinion regarding whether Jack and Ann Tatum, the landowners whose house is the subject, <br />in part, of the above-referenced Notice Of Violation can pamcipate as a "party" at the assessment <br />conference scheduled for January 9, 2001 and/or the Ivfined Land Reclamation Board (Board) <br />hearing scheduled for January 24.25, 2001. Based on my reading of the applicable statutory <br />provisions of the Colorado Surface Coal Mining Reclamation Act (CSCD'iRA), § 3433-124(a), <br />C.R.S. and the Colorado Administrative Procedures Act (CAPA), § 24~-105(c), C.R.S., it appears <br />that the Tatums are both persons "having an interest which is or may be adversely affected" by the <br />NOV under the CSCMRA and persons "who may be affected of aggrieved by agency action" under <br />the CAPA.
