CO 80203 <br />303 866-3567 <br />Fn%: 303 8328106 <br />February 7, 1990 <br />Mr. Mike Keegan <br />Kaiser Steel Resources <br />Star Route 3 Box 52 A <br />Pagosa Springs, Colorado 81147 <br />RE: CCMC Diversion Ditch (C-81-024) <br />Dear Mike: <br />As I indicated during our phone conversation on Tuesday, Kaiser Steel <br />Resources needs to submit a technical revision to the CCMC permit to <br />address the problem of sediment pond capacity following removal of the <br />west diversion ditch. Without a diversion to intercept runoff from the <br />undisturbed uphill area, the pond is not adequately sized according to <br />the Division's calculations. <br />p4ppCO~O <br />:I :~rr.,p <br />:" i. <br />~~,~. <br />~ l e'I 6 ~ <br />Roy Romer -- _~--- - -- <br />Governor <br />Freo R Banta. <br />Division D:reaar <br />It would appear that the situation can be resolved in one of two ways: <br />install a diversion ditch along the route of the previous ditch with <br />capacity to intercept the upland runoff resulting from a 2-year, 24-hour <br />precipitation event, or enlarge the sediment pond so it will store runoff <br />from the reclaimed and upland areas resulting from a 10-year, 24-hour <br />event. <br />During our phone conversation, you mentioned the possibility of <br />containing the undisturbed area runoff in a low area near the pit site. <br />The Division cannot approve such a plan. Runoff would be crossing the <br />disturbed area at that point. Our regulations require that all runoff <br />from a disturbed area be passed through a sediment pond or treatment <br />facility. A low-lying area such as the one you referred to is not a <br />treatment facility. <br />As part of its response to a Ten Day Notice from the OSMRE, the Division <br />requires that Kaiser Steel Resources submit the technical revision by <br />March 12, 1990.
