In four separate orders, the Boazd assessed civil penalties, issued a cease <br />and desist order preventing further mining activities outside of the permitted boundaries and <br />ordered the Operator to undertake corrective actions within 180 days of the signed Board <br />orders. The Board orders were signed on January 21, 2005, which gave the Operator until <br />July 20, 2005 to comply. <br />The Operator now seeks an extension of 120 days from the Board-ordered corrective action <br />deadline to pursue a Section 112 reclamation permit and to perfect legal access to the <br />affected lands. <br />4. Based on the Division's recommendation and the Operator's apparent intent to comply with <br />the Board's corrective actions, it is appropriate to extend the deadline for Board-ordered <br />corrective actions for an additional 120 days or until November 17, 2005. <br />5. It is appropriate to condition such an extension on the understanding that thc; Operator shall, <br />in the interim, pursue a Section 112 reclamation permit with the Division, undertake <br />measures to gain legal access to the affected lands, and undertake measures necessary to <br />control silt deposits in Taylor Gulch. The Division staff is further instructed to inspect the <br />site prior to the August 2005 Board meeting and to provide an update to the Board at that <br />meeting. <br />
