I <br />have been somewhat confused by the bonding situation since my last <br />correspondence with the Division and Fireman's Fund, the underwriter <br />of the bonds, and I have been trying to clarify the matter with all <br />concerned. <br />CF&I had received Notices of Cancellation from Fireman's Fund for the <br />Canon Dolomite Quarry (File M-77-376) and the Monarch Quarry (File <br />M-77-377) and immediately investigated the situation. CF&I was <br />informed by Fireman's Fund that the bonds were still in effect except <br />that they would only cover areas disturbed by mining prior to the <br />cancellation notice. Apparently Fireman's Fund had also contacted <br />the Division informing them of the situation as well. Since that <br />time the Division notified CF&I that the "Cancellation is in effect <br />only for disturbances subsequent to the effective date of <br />termination". Because CF&I had filed a Notice of Temporary Cessation <br />for the Canon Dolomite Quarry (File M-77-376) with the Division on <br />September 28, 1984, and obtained an additional Certificate of Deposit <br />as surety for the Monarch Quarry (File M-77-377), CF&I felt and still <br />asserts that all required bonding is in full effect.
