Long <br />Division Direcror <br />RE: Notice of Violation CV-97-014, Bowie No. 2 Mine, Permit No. C-96-083, Bowie <br />Resources Limited. <br />Dear Mr. Bear: <br />The Division is issuing Notice of Violation (NOV) CV-97-014, for failure to obtain <br />regulatory approval prior to implementing significant changes to the mining plan and for <br />failure to follow the approved mine plan. This NOV was the result of the August 1, 1997 <br />meeting at the Division between Bowie Resources Limited and the Division, and the <br />subsequent review of information submitted by J.E. Stover & Associates on behalf of <br />Bowie Resources. The NOV is enclosed with this letter. <br />The issue that resulted in this NOV was presented to the Division by Bowie Resources <br />Limited at the August 1, 1997 meeting. At that meeting, Bowie Resources informed the <br />Division that an in-the-field decision had been made by Bowie Resources to revise the <br />design of the facilities area configuration. The various elements of the design changes are <br />stated in the August 8, 1997 letter from Jim Stover to the Division. One of the design <br />changes involved the conversion from two separate benches for the portal area and the <br />coal stockpile area, to a larger, single bench. However, as Bowie Resources stated to the <br />Division, Bowie Resources chose to initiate the construction of the larger, single bench <br />prior to obtaining the necessary approval from the Division for the change to the mine <br />plan. A review of the certified drawings and cross-sections supplied by Bowie Resources, <br />coupled with an examination of aerial photographs taken by the Division on July 15, <br />1997, confirm that unapproved cut and fill operations had been initiated without Division <br />approval. Apparently, the other desired changes to the mine plan have not been initiated <br />
