<br /> <br />CIVIL PENALTY (C.RS. 34-32.5-123) <br />-2- <br /> <br />1. Require the operator and/or landowner to pay a minimum civil penalty in the amount of <br />$500:00, based on 15 hours to staff time at $33.30/hour. <br />2. If the Boa finds the operation to be an illegal Construction Material Extraction <br />Operation, th ~Board should also assess the operator and/or landowner a civil penalty of <br />not less than $1,Dt\0.00 per day nor more than $5,000.00 per day for each day the land <br />has been affected, not to exceed 365 days. <br />a. In this case, the Office recommends that the Board find 57 days of <br />violation at $I~000.00 per day. <br />b. The total civil p\Ity of $57.500.00 (Nos. 1 & 2) is due 30 days from the <br />date of the signed Board Order. <br />c.
