~ i F NOTICE OF PROPOSED DECISION The Colorado t4ined Land Reclamation Division has approved an application for a permit revision (PR - O1) to the existing permit to conduct coal mining and reclamation operations submitted by the Walden Coal Company for the Bourg Strip. The revision centered on a modification of the sediment control plan to utilize terrace ditches as treatment facilities to control offsite sedimentation. The revision included changes in the post-mining topography map and an alteration of the rill and gully monitoring plan. The Bourg Strip operation is located in Jackson County, approximately 5 miles northeast of Walden, Colorado. The mine is a surface mine undergoing reclamation. The coal which was mined was privately owned, and the surface to be affected was privately owned. The revised permit area encompasses approximately 175.8 acres in Sections 7 and 18, Township 19N, Range 78W, Jackson County Colorado. This proposed approval decision is based on a finding that the proposed operation will comply with all requirements of the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101, et seq., and the regulations promulgated thereunder. Copies of the proposed decision including stipulations, are on file for public inspection at the Colorado Mined Land Reclamation Division, Room 215, Centennial Building, 1313 Sherman Street, Denver, Colorado 80203 and at the County Clerk's Office in Jackson County, Box 337 396 Lafever St, Walden, CO. Persons with an interest that may be adversely affected by the proposed decision may request a formal hearing before the Mined Land Reclamation Board on the proposed decision. Such request must be made within thirty (30) days of the initial publication of this notice, must be in writing, and must state with reasonable specificity the reasons for the request and the objections to the proposed decision.
