<br />October 1988 states, "Areas disturbed prior [o August 3, 1977 which have been in continual use by <br />the mining operation...are not considered "previously mined areas." Such areas are subject to the <br />revegetation success standards of Rule 4.15.8." <br />3) Sandy and I were in agreement that the operator could consider backfilling of the portal as re- <br />initiating the liability period in that portion of the mine. Hence it may be possible to conduct <br />restricted interseeding or transplanting of native species as allowed by Rule 4.15.7(5). <br />4) In reference to the question of whether the portal area could be exempted as an industrial land use, I <br />will excuse myself from that determination, and stick with vegetative issues.
