Her <br />estimate of the number of hours it would take to complete the office <br />work associated with each sampling was considerably underestimated. <br />Her failure to conduct monitoring during the specified period is <br />apparently inexcusable and represents failure to abide by the contract. <br />The Division can do several things: <br />1. Remove RCG/HBI as the third party monitoring contractor. <br />This will require spending time with the citize a explaining <br />the circumstances if they follow the situation s closely as <br />they have in the past. The Board will nee to approve <br />changing the contractor, and this will require lot of prep <br />time and board time, possibly with an uncertai~ outcome. <br />2. Revise the MOU to change the sampling schedule.i <br />This could be simple, provided BMRI approves of the change. <br />However, it will require at least one meeti with Dean <br />Massey, review of a draft amendment, and si ing of the <br />amendment. Depending on how BMRI decides to ,proceed, it <br />could get contentious. <br />3.
