The Division commends Reclamation Resources for <br />this commitment. <br />The applicant has also specified a 50-foot buffer zone fr the Columbia <br />Ditch. The Division requests that Reclamation Resources r fer to the <br />Colorado Mined Land Reclamation Act regarding permanent st uctures and <br />respond accordingly. Section 34-32-115(4)(d) of the Color do Mined Land <br />Reclamation 101, et seq., C.R.S.) states that: <br />"The Board shall not deny a permit, except for one or ore of the <br />following reasons: <br />(d) The mining operation will adversely affect the stabili of any <br />significant, valuable, and permanent man-made structur s located <br />within two hundred feet of the affected land, except w re there is <br />an agreement between the operator and the persons havi g an interest <br />in the structure that damage to the structure is to be compensated <br />for by the operator". <br />7. Water Diversion <br />An existing diversion from the Columbia Ditch and buried pipe is <br />indicated in Plate 2. Please provide a discussion of the iversion <br />including diversion design, flow capacity, materials used in <br />construction, and proposed location. <br />8. Alma WWTP <br />Please identify and discuss the Alma WWTP shown on Plate 2. <br />Exhibit E - Reclamation Plan <br />1. Excess Tailings <br />The applicant has proposed to back fill excavations with tailings. The <br />material swell factor (estimated at 60 percent) should be erified so <br />that a materia7.balance can be developed. Will the excess "spoil" <br />material be used to backfill depressions within the permit boundary to <br />create a gently sloping southwest facing landform? Will t excess spoil <br />~ material be used to enhance reclamation of historic mining isturbance <br />outside the 200-acre permit boundary?
