•~ STATE OF COLORADO MINED LAND RECLAMATION BOARD DEPARTMENT OF NATURAL RESOURCES IN THE MATTER OF: Ready Mixed Concrete) NOTICE OF VIOLATION M-95-032 Company, Inc. ) AND 4395 Washington ) CEASE AND DESIST ORDEA P.O. Box 2290 ) Denver, CO 80201 ) TO: Ready Mixed Concrete Company, Inc. and all other persons engaged in or owning or controlling the following operation: Bromley Lake Pit, Permit No. M- 87-049. FINDINGS OF FACT Pursuant to the authority vested in the State of Colorado Mined Land Reclamation Hoard by C.R.S. 34-32-124, the Board hereby makes the following findings of fact: 1. Ready Mixed Concrete Company, inc. ie permitted to conduct a mining operation under the terms of Permit M-87-049 located in portions of Sections 11 through 14, Township 1S, Range 67W, of the 6th P.M., in Adams County, Colorado. 2. The Mined land Reclamation Board conducted a Formal Public Hearing on March 30, 1995 to consider possible violation of the terms of Permit M-87-049 and C.R.S. 34-32-101 et sec. 3. The Division of Minerals and Geology presented evidence at the Formal Public Hearing on March 30, 1995 demonstrating that: a. Operator has failed to protect areas outside the permit area from damage during the mining operation and reclamation. NOTICE OF VIOLATION Based upon these same Findings of Fact and in accordance with C.R.S. 34-32- 124(6), the Colorado Mined Land Reclamation Hoard hereby finds Ready Mixed Concrete Company, Inc. to be in violation of Permit M-87-049, 34-32-116(7)(h) and Rule 3.1.5(3) of the Mineral Rules and Regulations of the Colorado Mined Land Reclamation Board. CEASE AND DESIST ORDER Based upon these same Findings of Fact and Notice of Violation, and in accordance with C.R.S. 34-32-124(2),(6) and (7), the Colorado Mined Land Reclamation Board hereby orders Ready Mixed concrete Company, Inc. to: 1. Cease and desist from conducting the following mining operations at the Bromley Lake Pit, Permit M-87-049: any further mining related activities on areas outside the present permit area.
