M-87-092 <br />Reason to Believe a Violation Exists <br />Dear Mr. lr Mrs. Burdick: <br />aF. ~O/o <br />v,l <br />`'-. r~l.- `1~~ <br />.\~-~: <br />/8 T6' <br />Roc Ro mrr <br />Gnern or <br />N ichael B Wn/; <br />Drvi sign DveUOr <br />On Novembf~r 16, 1992 we conducted an inspection of your mine and found mining, <br />stockpiling and rock storage outside the permit boundaries. <br />We believe this is in violation of C.R.S. 34-32-116(7)(h) of the Colorado Mined Land <br />Reclamation Act and Rule 6.1(2) of the Rules and Regulations of the Mined Land <br />Reclamation Board. <br />Therefore, we have found reason to believe a violation exists to Permit M-87-092 and <br />the Law and have scheduled this matter before the Mined Land Reclamation Board. <br />A Formal Public Hearing will be held during the December 16-17, 1992 Board meeting <br />for consideration of possible violation. The hearing will be held in Room 318 of <br />1313 Sherman Street, Denver, Colorado, beginning at 9:00 a.m. or as soon thereafter <br />as the matter can be considered and you will have the opportunity to be represented <br />and heard. It will be reiterated that there is reason to believe that you are in <br />violation ~~f the provisions noted above. <br />If the Board finds a violation at this hearing, it may issue a cease and desist <br />order, assess a civil penalty in the amount of $50.00 to $200.00 <br />for each d<ly of violation or order the permit be suspended, modified or revoked. In <br />addition ii: may set the matter for consideration of forfeiture of the $3,000.00 <br />financial warranty at a subsequent hearing.
