Long. <br />Division Director <br />Re:Technical Revision No. 12; North Thompson Creek Mine (C-81-025) <br />Response to 7/8/92 letter <br />Dear Mr. Kelley: <br />The new Office of Mined Land Reclamation has received your letter <br />referenced above regarding Y.lze Garfield County Commissioners <br />decision; the "Resolution", on re-zoning the loadout in the area <br />known as the Diamond-A parcel. According to the information <br />included in your letter, the "Resolution" has approved the Aspen <br />Glen Planned Unit Development plan together with the zoning change <br />from "agricultural" to "residential and industrial" respectively. <br />In addition, field inspection on June 25, 1992 confirmed that both <br />concrete footers, located on the east bank of the Roaring Fork <br />River have been reclaimed. <br />It is therefore, in keeping with the Mined Land Reclamation's <br />decision and findings document, and compliance with Rule 3.03.2, <br />that the area previously known as the "loadout" is released from <br />all performance standards when the remaining two conditions are <br />met. One, "once Aspen Glen begins construction activities on the <br />Diamond-A Parcel," and secondly (as is stated in the findings <br />document), "public liability insurance must be maintained as per <br />Rule 2.03.9, and that no portion of the area shall contribute <br />suspended solids to streamflow such that ambient sediment levels <br />are elevated," which is to be "determined by comparing upstream and <br />downstream water quality data." <br />s~ <br />Please feel free to contact either myself or Larry Routten at our <br />offices if you have any questions. <br />
