Box 39 Drvision Director <br />Crested Butte, CO 81224 <br />RE: Mountain View Pit (Permit M-81-002) Approval of Technical <br />Revision 03 <br />Dear Mr. Crank: <br />On February 1, 1995, the Colorado Mined Land Reclamation Board <br />approved the technical revision application submitted to the <br />Division on January 20, 1995 requesting that the reclamation <br />requirement for the floor of the pit be satisfied by the presence <br />of 'a gravel surface without a requirement for the development of <br />vegetative cover. This revised requirement would both be <br />consistent with the intended use to be made by the Town of the pit <br />floor in the future and with the currently approved post-mining <br />land use of a calving and corral area for livestock. This approved <br />revision does not represent a significant change in the approved <br />reclamation plan. <br />The terms of Technical Revision 3 approved by the Board are hereby <br />incorporated into Permit No. M-8I-002. All other conditions and <br />requirements of Permit No. M-81-002 remain in full force and <br />effect. <br />In addition to advising you of the approval of the minor change in <br />what would be normal reclamation requirements for the pit floor, I <br />would like to make sure that you understand the limitations of the <br />Board's January 25, 1995 action in waiving the requirement that a <br />state reclamation permit be obtained for the movement of material <br />into the Mountain View Pit from the adjacent highway right-of way. <br />If, as you indicated to the Board, that material is to be used in <br />reducing the slope of the pit highwall, the Town, as operator of <br />the Mountain View Pit, will still be required to meet applicable <br />reclamation performance standards as regards the stability of that <br />highwall (See Rule 3.1.5). I was not sure that Mr. Bruce Humphries' <br />remarks to this effect were noted by you during the meeting with <br />the Board on January 25, 1995. <br />If you have any questions on the above, please contact me. <br />
