Cattany <br />Division Director <br />Natural Resource Trustee <br />DRMS has completed review of the proposed modification of Sediment Pond 1 &2, <br />which was included within the PR-4 application. Our pond review had not been <br />completed in time to include review comments in the preliminary adequacy review letter <br />of September 25, 2007. <br />The pond re-design documentation appears to be accurate, appropriate, and professionally <br />presented, and we have identified no deficiencies. A portion of the excess capacity that <br />currently exists will be eliminated in the reduced size pond. Runoff from the design 25- <br />year, 24-hour storm event is estimated to fill the modified pond to within approximately <br />0.5 feet of the lowest primary riser discharge point. As such, all storm runoff would be <br />properly contained. <br />We note that, following storm runoff into the pond, the pond water must be discharged by <br />pumping after sediment has settled, to maintain required storage capacity. Manual <br />discharges must be sampled to demonstrate compliance with applicable effluent <br />limitations, including total suspended solids (TSS). <br />Further, we note that permanent impoundment demonstration pursuant to Rule 4.05.9(13) <br />will be required before the Division can approve permanent retention of the pond. <br />Please contact me if you have any questions. <br />Sincerely, <br />Daniel T.
