<br />The existing Somerset Mine permit area contains 5,529 acres, of which 1,678 <br />acres are on private land, and 3,851 acres are on federal land. Of the 1,678 <br />acres of private land, 1,669 are owned by Somerset Mining Company. <br />The mine site is located north of the town of Somerset, Colorado. The North <br />Fork of the Gunnison River is located south of the town of Somerset. The mine <br />permit areas are located on the U.S. Geological Survey 7.5 minute Bowie and <br />Somerset Quadrangle maps. <br />Proposed Decision <br />The Colorado Division of Minerals and Geology proposes to approve, with the <br />following stipulations, an application for renewal of a valid, existing permit. <br />Stipulation No. 14 <br />Somerset Mining Company must submit a mine plan change to, and receive <br />approval from, all applicable state and federal agencies before pulling <br />pillars from the B seam underneath any unmined C seam areas with less <br />than 1,500 feet of cover. <br />Stipulation No. 16 <br />The operator will, pursuant to Rule 4,10,2(2)(b), submit to the Division <br />as part of the quarterly coal mine waste pile inspection report, <br />compaction test results for that pile. Testing will take place on an <br />as-needed basis, depending on the rate at which the pile receives coal <br />mine waste, to ensure stability of the pile. <br />Stipulation No. 17 <br />All issues identified in the Division's permit renewal adequacy letter of <br />June 11, 1993 and included in the SMC July 26, 1993 adequacy response/ <br />Technical Revision No. 17 application will be addressed to the Division's <br />satisfaction by October 15, 1993. <br />Note: Stipulation Nos. 1 through 13 and No. 15 were all previously complied <br />with. <br />The application was submitted by Somerset Mining Company for the Somerset Mine <br />and Sanborn Creek Tract. This decision is based on a finding that the <br />operation will comply with all requirements of the Colorado State Program as <br />found in the Colorado Surface Coal Mining Reclamation Act, C.R.S. 34-33-101 et <br />seq., and the Regulations promulgated pursuant to the Act. If no request for <br />a formal hearing is made within thirty (30) days of the first publication of <br />the issuance of this proposed decision, then this decision becomes final. The <br />permit renewal application, all supporting documentation and any stipulations <br />or conditions will become a binding part of the permit. <br />-3- <br />
