PQabody <br />Twentymile Coal Company <br />Memo <br />f2EDEIVED <br />NOV 17 2006 <br />Mining ano Barely <br />To: Dan Hernandez <br />From: Jerry Nettleton <br />Date: November 17, 2006 <br />Re: Twentymile Coal Company - Foidel Creek Mine (Permit C-82-056), NOV <br />CV-2006-006 -Fulfillment of Abatement Step 9 <br />Dan - <br />As indicated in our Abatement Status Report of 10/12/06, Abatement for <br />Steps 9 and 10 (Reestablish DRMS approved Sediment Controls, and <br />Submit as-built construction drawings) has involved modification of Pond <br />E, under a field authorization, to reestablish design sediment and <br />stormwater runoff storage capacity and development of "as-built drawings <br />for the current temporary configuration. Accompanying this transmittal <br />(hand-delivered on 11/17/06) is an "as-built" drawing showing the current <br />pond configuration with stage-storage information documenting sediment <br />and stormwater storage capacity. <br />For reference, the approved designs for Pond E specified sediment storage <br />(3-years) capacity of 0.71 acre-feet, and stormwater (10-year, 24-hour <br />runoff) storage capacity of 1.59 acre-feet, for a total design storage <br />capacity of 2.30 acre-feet. In its current (temporary) configuration, the <br />southern portion of Pond E provides more than the total approved design <br />storage capacity for sediment and stormwater runoff, and will serve to <br />meet the related drainage and sediment control requirements until such <br />time as permanent modifications are made. <br />We appreciate your consideration and assistance as we resolve the final <br />issues associated with our unanticipated coal fines discharge.
