File No ..C-048-81 <br />1675 Larimer, Suite 750 <br />Denver, Colorado <br />All persons wishing to present testimony were sworn. <br />Secs. 15 and 22, T3iS, R65W, Las Animas County, 1150 acres. Surface <br />coal reclamation only, Protest re NOV's C-85-013 and C-85-076. Staff <br />submitted ATTACHMENT L, Outline for Trinidad Basin Mining Board Hearing. <br />Mr. Greg Lewicki and Mr. Vance Mills of Trinidad Basin Mining addressed <br />the Board relative to the reclamation work that has been done and <br />requested that the Board accept the voluntary on-the-ground reclamation <br />in lieu of cash for the civil penalties accrued for enforcement actions <br />and that the Board allow the Trinidad and Ludlow load-outs be left <br />unreclaimed for one year. Slides were shown. <br />It was MOVED that the Board accept the voluntary reclamation in the <br />amount of 52,950 as payment for the civil penalties of X24,760 with the <br />understanding that this is a unique situation and that the Board does <br />not condone previous reclamation before a civil penalty has been <br />assessed or reclamation done without consultation with the staff. <br />SECONDED and PASSED by a Vote of 5 for (Winter, Blach, Hullinghorst, <br />Holder and Campbell)/2 opposed (Getches and O'Connor). <br />After hearing testimony relative to the load-out reclamation, it was <br />MOVED that the enforcement actions taken relative to the load-outs be <br />stayed until January 1, 1987. SECONDED and PASSED UNANIMOUSLY (Holder, <br />Hullinghorst, Campbell, Blach, Winter, Getches and O'Connor). <br />Staff Presentation by Dan Mathews: <br />58. FORMAL PUBLIC HEARING <br />COLORADO YAMPA COAL COMPANY File No. 79-177 <br />29588 Routt County Rd. 27 <br />Oak Creek, Co. 80467 <br />All persons wishing to present testimony were sworn. <br />6,680 acres, Routt County, surface coal, Protest re NOV's C-85-40 and <br />C-85-041. Staff indicated that the operator has requested continuance <br />to the December Board Meeting. So MOVED, SECONDED and PASSED <br />UNANIMOUSLY (Holder, Hullinghorst, ac ,Winter, Getches and O'Connor). <br />
