Box 607 <br />Cheyenne Wells, Colorado 80810 <br />Re: Cheyenne County Alternate Reclamation Plan <br />File Nos. 83-105 and 83-106 <br />Dear Mr. Arends: <br />In reviewing documents given to me by Joe Zalkind just before he left the <br />employ of our Division last April, I discovered that there are several <br />unresolved issues concerning the reclamation plan submitted by Cheyenne County <br />as an alternative to the $3,000.00 unsuspended portion of the civil penalty <br />previously assessed against Cheyenne County. A status report on the progress <br />on these matters was to have been given to our Board during last month's <br />meeting. I now feel that such a status report should be given to the Board <br />during the upcoming, June 27-28, 1984 meeting. <br />Please send me a letter that accomplishes the following things: <br />1. Please respond to the letter from Mr. Beavers to you of December 30, <br />1983. A copy of his letter is enclosed. <br />2. A resolution of the problem concerning exactly how this area was to be <br />reclaimed and by whom was to have been reached by now. Please give us <br />the details of this finalized plan. <br />3. Any soils and vegetation analysis needed from the Soil Conservation <br />Service concerning the area to be reclaimed should be submitted along <br />with the other materials mentioned above. <br />4 Any changes to the reclamation plan that may have occurred over the last <br />few months should be mentioned. <br />The fina]ization of a reclamation plan for a site that can be executed by <br />Cheyenne County, inspected by our staff and then released by our Board is <br />essential to offset the payment of the remaining $3,000.00 civil penalty. <br />Until that series of actions is accomplished, payment is merely deferred, not <br />423 Centennial Building, 1313 Sherman Street Denver, Colorado 80203 Tel.
