Tate -3- !'ebrvary 17, 1982 (b) A brief description of the particular violation alleyed in the notice; (c) The date, Location and rype of any administrative or judicial proceedings initiated concerning the violation, including, but not limited to, proceedings initiated by the applicant to obtain administrative or judicial -- review of the violations; (d) The current status of the proceedings and of the violation notice; (e) The actions, if any, taken by the applicant to abate the violation; and (f) The Final resolution of any notice of violation. 2.04.3 General Requirements: Site I~scriotion and Land Use Information A11 of the information required by Sections 2.09.3 (pre-mining land use) and 2.05.5 (post-mining land use) has been provided. The locations of the pertinent exhibits is mislabeled in the body of the application. Exhibit A is listed on page 16 of the application as pertaining to the pre-mining Zand use. This exhibit is, in fact, Che mine plan. Exhibits K and L pertain to the pre- and post-mining land uses. Blue Ribbon Coal~Company must provide revised versions of page 16 which correctly identifies Exhibit K as the map of pre-mining land use. Additionally, Exhibits K and L need to be revised to include the D1ue Ribbon truck scale facility. 2.05.9 Reclamation Plan While reviewing the reclamation plan, a problem with reclamation timing was identified. There occurs a statement on pages 108-109 that ..."reclamation of the portal bench, access reads, sediment ponds, coal stockpiles and truck scale site will be concurrent." The rules specify that sediment ponds must remain in place until the water from the site meets effluent limitations wiChout treatment, state receiving stream standards and that vegetation success criteria have been met. The proposal to reclaim sediment ponds concurrently with other reclamation activities is unacceptable. Blue Ribbon Coal Company must revise the reclamation plan to show that sediment ponds will remain in place until all of the conditions specified in 4.05.6(9) have been met. Geology = Blue Ribbon Coal Company has submitted a generalized geologic map (Exhibit R) which only covers the surface disturbance area. This map does not adequately show the geology of the permit and adjacent areas. Blue Ribbon Coal Company has committed to submitting a new map with the site-specific geology after the snow melts and field work can be conducted (see legend of ExhibiC R). Dlue Ribbon Coal Company has also agreed to plot the croplines of the alluvium in Hubbard Creek on a new hydrology map. When the Division receives the hydrology map, there will be sufficient geologic information in the permit to make written findings.
