r
' r~
April 5, 1990

SOMERSET MINING COMPANY
Mr. Steven L. Posey
District Ranger
U.S. Forest Service
Rio Grande Avenue
Paonia, CO 81428
~' . .. ~. ..,. .,. -1~
Dear Mr. Posey: .
On December 1, 1990, a partnership between the Pacific Basin Resources divi-
sion of Oxbow Carbon & Minerals, Inc., and Bear Coal Catgtarty, Inc., purchased
all of the assets of F~aiser Coal Corporation near Somerset, Colorado. This
property, which was previously owned by United States Steel Corporation is
also known as the Swnerset Mine.
Recently, Somerset Mini-ng Carpany began the process of transferring the Colo-
rado Mined Land Reclamation Permit on the property to our nacre. As a result
of our efforts in this regard we discovered that a stroll portion of the dis-
turbed area on the Sanerset Mine property is located upon land owned by the
United States Forest Service. Specifically, the land is adjacent to the site
where United States Steel Corporation had a substation in the Hubbard Creek
area.
Section 2.07.6, Rule 114(2)(II) of the Regulations of the Colorado Mined land
Reclamation Board states that the permit area of a urine cannot be located, "On
any Federal lands within the boundaries of any national forest; except that
surface coal mining operations rosy be permitted on such lands if the Secretary
finds that there are no significant recreational, timber, eeonani-c, or other
values which may be incarrpatible with such surface mining operations, and
Surface operations and impacts are incident to an underground coal mine;".
Pursuant to this rule, it is necessary for us to obtain a determination from
the Secretary that no significant recreational, timber, econani-c or other
values are incatgaatible with the surface disturbance on the Somerset trrinesite.
We therefore respectfully request that your office undertake an evaluation of
the disturbance at the Hubbard Creek site, and submit your determination to us
as soon as possible.
Sincerely,
SOMERSEP MINING ~1PANY
Cra' N pr ng r
M r - Manag t Committee
cc Jim Stover
P.O.
