Posey <br />District Ranger <br />U.S. Forest Service <br />Rio Grande Avenue <br />Paonia, CO 81428 <br />~' . .. ~. ..,. .,. -1~ <br />Dear Mr. Posey: . <br />On December 1, 1990, a partnership between the Pacific Basin Resources divi- <br />sion of Oxbow Carbon & Minerals, Inc., and Bear Coal Catgtarty, Inc., purchased <br />all of the assets of F~aiser Coal Corporation near Somerset, Colorado. This <br />property, which was previously owned by United States Steel Corporation is <br />also known as the Swnerset Mine. <br />Recently, Somerset Mini-ng Carpany began the process of transferring the Colo- <br />rado Mined Land Reclamation Permit on the property to our nacre. As a result <br />of our efforts in this regard we discovered that a stroll portion of the dis- <br />turbed area on the Sanerset Mine property is located upon land owned by the <br />United States Forest Service. Specifically, the land is adjacent to the site <br />where United States Steel Corporation had a substation in the Hubbard Creek <br />area. <br />Section 2.07.6, Rule 114(2)(II) of the Regulations of the Colorado Mined land <br />Reclamation Board states that the permit area of a urine cannot be located, "On <br />any Federal lands within the boundaries of any national forest; except that <br />surface coal mining operations rosy be permitted on such lands if the Secretary <br />finds that there are no significant recreational, timber, eeonani-c, or other <br />values which may be incarrpatible with such surface mining operations, and <br />Surface operations and impacts are incident to an underground coal mine;". <br />Pursuant to this rule, it is necessary for us to obtain a determination from <br />the Secretary that no significant recreational, timber, econani-c or other <br />values are incatgaatible with the surface disturbance on the Somerset trrinesite. <br />We therefore respectfully request that your office undertake an evaluation of <br />the disturbance at the Hubbard Creek site, and submit your determination to us <br />as soon as possible. <br />Sincerely, <br />SOMERSEP MINING ~1PANY <br />Cra' N pr ng r <br />M r - Manag t Committee <br />cc Jim Stover <br />P.O.
