No~2 ~~ <br />Permit Commitment Letter ~l,m w ~-ll halo( <br />Permit No. M- 9-002 <br />Yankee Gulch Sodium Minerals Project <br />Dear Mr. Sorenson: <br />Telephone (970) 285-0427 <br />Toll Free (877) SODA-ASH <br />Facsimile (970) 295-6185 <br />In response to your letter dated June 23, 2000, American Soda would like to express its intent <br />to take advantage of the bonding option provided by Rule 4.2.1(8) for the Yankee Gulch Project. <br />Accordingly, a bond rider in the amount of $4,214,000 was submitted to BLM on July 11, <br />2000. This submittal to BLM, in addition to the $210,424 bond rider submitted to the <br />Colorado Mined Land Reclamation Board on July 11, 2000, brings American Soda's total <br />Financial Warranty amount posted with the BLM and DMG to $4,424,424. For your <br />information, and in response to your request, the BLM will be providing a letter directly to your <br />office documenting BLM's receipt of this Financial Warranty. <br />In addition and per your instructions, American Soda would like to make the following permit <br />commitment to the Colorado Division of Minerals and Geology regarding the Yankee Gulch <br />Sodium Minerals Project: <br />In the event that the Bureau of Land Management (BLM] makes a decision to reduce or release <br />the Financial Warranty held for the Yankee Gulch Sodium Minerals Project, American Soda, LLP <br />(the Operator] or their successor will post an acceptable replacement warranty with the <br />Colorado Mined Land Reclamation Board (Board] prior to any release or reduction action by the <br />BLM. The replacement Financial Warranty posted with the Board will be in an amount equal to <br />the amount to be released by the BLM unless the Board or the Division of Minerals and Geology <br />conducts an inspection of the Yankee Gulch Sodium Minerals Project permit area and issues a <br />finding of concurrence or partial concurrence with the Financial Warranty release or reduction <br />decision of the BLM. <br />Natural Sodium Products For A Cleaner Environment <br />
