The Division of Minerals and Geology has required <br />Somerset Mining Company to submit a technical revision application no later than November 14, <br />1994, which addresses all aspects of the Approximate Original Contour Variance rules cited in <br />the TDN. These rules include the issue of landowner consent, and this issue will be addressed <br />with our consideration of the forthcoming technical revision. <br />Resolution of these issues may include ground surveys, site inspections, and communications with <br />other agencies. Technical revision processing is governed by Colorado regulations, allowing <br />specific timeframes and requiring specific public notification processes. These combined factors <br />necessitate utilization of the full amount of time allowed and mandated by Colorado regulation. <br />The situation does not constitute an emergency. The initial joint inspection occurred May 11, <br />1994, and the OSM repoR was received July 22, 1994. The TDN was not received until <br />October 3, 1994. Our need to utilize the previously specified timeframes is both reasonable and <br />necessary.
