New Elk Mine held during <br />August.-: TO- through 12, : th=ee 'NOVS were issued:. _ These NOVA were <br />directly .related to a greater. than 10 year/24 hour rain storm which <br />hit the nine ion August .3: . Due.ao the unusual and" intense nature of <br />'- . ' ~ the ,eveat,~'which 'exceeded the. design capacity,of control structures <br />as;required..by.the.New..Elk Mine permit sad applicable regulations, <br />Basin 'requests that DMG, consider the following facts in their <br />assessment of• these `three PTOVa. <br />Events Surroundinv the'Pioblems Cited•in-the NOVs <br />The New .Elk: Mine permit 'require .the structures identified in <br />-'. :the.NOVs`to,be designed to•fiandle.a,.l'0 year/24 hour precipitation <br />evenC. For.this mine;':.euoh' a ,storm corresponds to 2.9" of <br />j ~ precipitation £or the•entire_24=hour~p'eriod~. ~ - <br />. _ <br />! .; <br />`.~ However, the storm o.f August 3.exceeded .the.l0 year/24 hour <br />precipitation event standar3, and for tkiat reason alone caused the <br />conditions identified in the.~NOVe.. A total of 2.99" of rain fell <br />i during this event, of which' 2.65". fell during an intense 4 hour <br />period.. It was this intense•cloudburat.that caused the problems <br />which were seen during the inspection: <br />- - Immediately Following ,the '.August 3 storm, Basin .began <br />remedying the problems caused by the storm. Basin committed <br />substantial resources to this cleanupi it devoted approximately <br />500 manhoura and $20,000 to .cleanup activities from the time of the <br />storm until. the inspection tour ended.
