Frei <br />and Sons was allowed by the MLRB to expand mining operations <br />associated with the Walstrum Mine outside the perimeter <br />boundary of its approved mining plan. Jim McArdle of your <br />staff has advised us that this was accomplished without the <br />benefit of the County's review because it was designated by <br />the MLRB as a "technical revision." Had the County reviewed <br />the application, we could have notified the MLRB that the <br />proposed expansion was inconsistent with County zoning. <br />In light of the Article 34, Title 32, CRS and other requirements <br />that MLRB permits not be in conflict with local land use laws, <br />this Board of County Commissioners hereby requests notification <br />of any proposed permit revisions in Clear Creek County which <br />would affect lands not previously reviewed by the County. <br />Thank you for the otherwise sufficient opportunity to partici- <br />pate in MLRB decision-making. <br />Yours truly, <br />~!°°'~ ~ i <br />James G.
