TRAPPER MINING INC. 999
September 13, 1995
Mr. Joe Dudash
Environmental Protection Specialist
Colorado Division of Minerals & Geology RFrPIVEr
1313 Sherman Street, Room 215 SEP 15 1995
Denver, CO 80203
Dear Mr. Dudash:
Division of Minerals 8 Geology
Re: Trapper Mine, Permit No. C-81-010
Settlement Agreement - NOV C-95-017
Please fmd enclosed a signed Settlement Agreement for the above-referenced Notice of Viola-
tion. Also enclosed is a check for $250 to satisfy the penalty assessment.
Trapper decided to accept this settlement agreement for the following reasons:
1) We cannot justify continuing appeals of this NOV from an economic standpoint.
2) Susan McCannon expressed a willingness at the September 8, 1995 Colorado Mining
Association Coal Committee's meeting to examine and discuss with CMA the CDMG
policy of automatic issuance of NOV's for landslides, regardless of any external or miti-
gating circumstances. Trapper is anxious to be a part of this CMA/CDMG dialogue.
Trapper continues to disagree with CDMG's notion that the circumstances surrounding the
Ashmore Pit landslide constituted an enforcement action. We feel that since the slide occurred
as a result of unprecedented spring rainfall in association with several other unforeseen circum-
stances, the slide constituted a maintenance issue rather than an enforcement issue.
Please contact me if you have any questions.
Sincerely, )
/G
Forrest V.
