Also enclosed is a check for $250 to satisfy the penalty assessment. <br /> Trapper decided to accept this settlement agreement for the following reasons: <br /> 1) We cannot justify continuing appeals of this NOV from an economic standpoint. <br /> 2) Susan McCannon expressed a willingness at the September 8, 1995 Colorado Mining <br /> Association Coal Committee's meeting to examine and discuss with CMA the CDMG <br /> policy of automatic issuance of NOV's for landslides, regardless of any external or miti- <br /> gating circumstances. Trapper is anxious to be a part of this CMA/CDMG dialogue. <br /> Trapper continues to disagree with CDMG's notion that the circumstances surrounding the <br /> Ashmore Pit landslide constituted an enforcement action.
