2 <br />At this time (and at the time of the inspection which resulted in the TDN), the Colorado <br />program requires that haul roads be certified if required by the Division for good cause <br />shown. All certifications required by DMG have been submitted by the operator. <br />Consequently, the alleged violation does not exist. DMG believes it has responded to TDN <br />95-020-179-002 in an appropriate manner. <br />DMG has instructed the operator to revise the haul road certifications in question by June <br />15,1995. By doing so, the operator will be in compliance with the amended version of Rule <br />4.03.1 before that rule becomes effective. Among the certification exhibits to be revised is <br />Exhibit 13-13.2, which was the subject of alleged violation #2 of this same TDN. AFO <br />requested that DMG provide dates by which the permittee will be required to revise Exhibit <br />13-13.2. DMG has instructed the operator to revise the road certification exhibits by June <br />15, 1995. A copy of an excerpt from a May 5, 1995 DMG inspection report instructing the <br />operator to revise this and other exhibits is enclosed for your reference.
