Follo~:~ing submittal of the zinc data, the Division is [o I~.ake
a decision as to (dhether or not a limitation is indicated.
The data submitted demonstrates consistently lo~:~ levels of zinc in [he
effluent. Furthermore, in the interim betr:~een permit issuance and the
present, the Stream Standards and Classifications for the Lo~:er Colorado
have been adopted. No zinc standard ~~~as set for any of the receiving
~•:aters applicable to your mine site. The nearest classified segment
which has a zinc standard is Region II, Segment 2 of the Lo~.+er Yampa
River Basin (the Yampa between Lay Creek and the Green River). Segment 2
has a zinc instream standard of O.US mg/l.
The conclusion, in this case, is that the low zinc levels in the effluent
pose no threat to the nearest stream segment which has a zinc standard.
Tfius, the monitoring requirement for zinc is no longer appropriate and
may be deleted.
If you have any questions regarding [his, feel free to contact me. The
Spill Plan submittal is presently being reviewed and any comments relative
to the plan ~.~ill be sent under separate cover.
Very(~t~ruly yours, (~
Sandy Squire ( cc: EPA
Engineering Technician D.E.
Permits and Enforcement
L.'ater Quality Control Division
55/Ic
Enclosure
4210 EAST 11TH AVENUE DENVER,COLORADO 80220 PHONE (303) 320-6137
