-3- <br />SCHEDULE TO NOTICE OF VIOLATION <br />Notice of Violation No.: CV-98-002 <br />NATURE OF VIOLATION: <br />(a) Failure to construct haul road within the standards of vertical alienment, which state that the maximum <br />pitch grade should not be steeper than 15%: that there should not be more than 300ft of pitch are ade <br />exceedine ]0% within any consecutive 1000ft and in no case should grade be steeper than 15%, (b) Failure <br />to constntct haul road in accordance with approved plan and with horizontal alienment as consistent with <br />existing topoeraph~as possible and providin tg he alienment required to meet the performance standards of <br />ACT, REGULATION, OR PERMIT PROVISION(S) VIOLATED: <br />ACT <br />SECTION(S) 120(2)(q) <br />REGULATION <br />SECTION(S) 4.03.1(3)(a)(ii):4.03.1(3)(a)(iii); 4.03.1(3)(b) <br />PERMIT <br />SECTION(S) Exhibits 13-1 l.2 and 13-11.3 <br />PORTION OF THE OPERATION TO WHICH THIS NOTICE APPLIES: <br />Southernmost portion of Haul Road B between stations 56+00 and 62+00 <br />STEPS NECESSARY TO ABATE VIOLATION (REMEDIAL ACTION): <br />Either (1) Reconstruct Haul Road B according to the approved plan OR <br />(2) Demonstrate that the alternatives to criteria and specifications of 4.03.1(3) will be as environmentally <br />sound as those complyine with 4.03.1(3); that the alternatives meet such other criteria as are necessary to <br />achieve reclamation in accordance with this rule taking into consideration the characteristics of [he site, and <br />can be demonstrated usin~ppropriate engineering tests to meet a static safety factor of 1.3 at a minimum. <br />TIME FOR ABATEMENT (NOT MORE THAN 90 DAYS): <br />ON OR BEFORE Mav I S , 19 98 <br />WHITE -File YELLOW -Operator PINK -Specialist <br />
