III. COMMENTS -COMPLIANCE
Below are comments on the inspection. The comments include discussion of observations made
during the inspection. Comments also describe any enforcement actions taken during the
inspection and the facts or evidence supporting the enforcement action.
Excess Spoil and Development Waste
All the underground development waste which will be placed in the
Lone Pine Gulch pile is now on the surface. John Poulous of MCC,
who accompanied me and Mr. Barbe during the inspection of the Lone
Pine Gulch fan facilities, believes that there will not be as much
waste disposed of in the pile as originally permitted. MCC has
temporarily stored some refuse on the fan bench. This material
should be moved up to the pile as soon as road conditions allow.
MCC should also begin constructing the pile in lif;,s as permitted.
The east side of the refuse pile is close to fina~ grade with the
exception for some coal refuse that needs to be pushed up on the
slope. Wells SG-1 and GP-1 will not be lost as or'^~nally thought.
The regrading of the coal and replacement of tae subsoil and
topsoil should proceed as soon as conditions allow.
Offsite Support Facilities
Work is continuing on the Lone Pine Gulch fan. Both portals are
complete. Most of the fan housing has been constr::ated. MCC is
planning to spray Soil Guard on the slope above ti._ fan before the
end of May, weather permitting. The contractors, Parrick-Harrison,
have temporarily stored fuel and oil at the stagy^~ area. Some of
the barrels are leaking, but are within a berme3 a. ea. When the
contractors demobili2e, MCC should remove any conta= _:ated soil and
dispose of the soil properly. Mr. Barbe indicatE.3 he would use
absorbants to pick up water in the bermed area.
007INSO40595
