In addition, as of November 29, 1994, no on-the- <br />ground work had begun toward abating the violation even though climatic <br />conditions at that time would have allowed work to be ongoing. <br />At this time, I find you do not qualify for an extension of the current abatement date <br />of December 12, 1994. If a settlement, which meets the requirements of the <br />regulations, is reached prior to the current abatement date of December 12, 1994 I <br />would be open to a request for an extension. <br />If you do not agree with this decision concerning your request, you have the right <br />under 43 CFR 4,1281 et seq., to appeal to ttte Office of Hearing and Appeals.
