Long <br />Division Director <br />Re: Appeal by Mr. Richazd Randall Regarding AVS Link to Randall and Blake of <br />Oklahoma. <br />Dear Ms. Schellenger: <br />1 would like to thank you and your office for keeping us informed of the history and <br />information regarding outstanding civil penalties linked to Randall and Blake of Oklahoma. <br />As you and I have discussed, Mr. Richard Randall is linked in the AVS to Randall and <br />Blake of Oklahoma and to an operator, Landmark Reclamation, Inc., here in Colorado. We <br />have been informed that Mr. Randall has appealled his connection to Randall and Blake <br />of Oklahoma with your office. <br />We have received a copy of the letter of appeal submitted in Mr. Randall's behalf by D.D. <br />Hayes on May 23, 1995. At this date we have not received written confirmation from <br />Oklahoma Department of Mines that the appeal process has been initiated or the date of <br />a scheduled hearing. Please send written affirmation from the State of Oklahoma that the <br />appeal process is underway and the date the hearing is scheduled, if that is known. <br />Our interest in this case arises from a permit transfer on a reclaimed mine here in Colorado <br />of the permitee only. Landmark Reclamation is the operator and will continue to be the <br />operator, hence the problem with the AVS link. In our phone conversation on August 9, <br />1995 you indicated there was a way for Colorado to override the system recommendation. <br />We consulted with Mr. Keith Harrison, OSM-AVS Lexington, on this issue. Mr. Harrison <br />suggested that "exclusion codes" or even "temporary exclusion codes" can be placed on Mr. <br />Richard Randall pending the outcome of the hearing. <br />The State of Colorado Division of Minerals and Geology (CDMG) understands your office's <br />hesitation in placing a "conditional issue' on the company of Randall and Blake of <br />Oklahoma. Would "exclusion codes" or "temporary exclusion codes" on Richard Randall, <br />the individual, work in this situation? If this action would be in agreement with your <br />program, the CDMG would appreciate it if your office could enact a "temporary exclusion" <br />of Richard Randall while this case is under appeal. We understand that this would be <br />
