Ken Jacobson 9 May 2006 <br />Chief, Colorado/Gunnison Basin Regulatory Office <br />U.S. Anny Corps of Engineers <br />400 Rood Avenue, Room 142 <br />Grand Junction, CO 81501-2563 <br />Re: Request for a Jurisdictional Determination for the 3B- Enterprises -Deakins Pit - <br />Craig, CO (200375358). <br />Deaz Ken: <br />Enclosed is a completed wetland delineation report we have prepared for the 3B-Enterprises - <br />Deakins Gravel Pit located in Craig. This jurisdictional determination was conducted for the <br />purpose of addressing Corps of Engineers concerns about identifying potential jurisdictional <br />wetlands which might be affected by the expansion of the existing gravel mining operations at <br />this location. It is our understanding in discussing this project with the owner, Mr. Steve Baker <br />and Mr. Nathan Green of your office that Mr. Green has visited this site on several occasions and <br />that you have personally discussed this project at considerable length with Mr. Baker. <br />In order to ensure that the appropriate information has been collected and is being submitted, our <br />enclosed report addresses each of the information needs found in the document dated 30 <br />November 2001 which is published on the District's website entitled "Minimum Standazds for <br />Acceptance of Preliminary Wetlands Delineations." Our report addresses each information item <br />in a question and answer format to ensure that all of the information needed by your office to <br />evaluate this request is contained in our report. <br />Mr. Baker has requested that I inform the Corps of Engineers that be sees no need for your office <br />to verify this wetland delineation as he has decided to follow your advice and not place any fill <br />into the proposed mine expansion area which might contain jurisdictional wetlands. Following <br />your recommendations, he has determined that he can mine the proposed mine expansion area <br />without placing any fill into this area or potentially affecting any wetlands. His plans are to <br />excavate this azea and haul all of the excavated pit-run materials to his existing mine area, which <br />your office and the Colorado Division of Minerals and Geology have previously determined <br />does not contain any jurisdictional wetlands. He is very appreciative of your suggestions and it is <br />his intention of cazefully following your recommendations so all of his future mining actions <br />will not result in any fill being placed into any wetland azea and hence no 404-Permitting action <br />will be triggered.
