NOTICE OF PROPOSED DECISION <br />The Colorado Division of Minerals and Geology has issued a proposed decision <br />to approve an application for a revision (PR-04> to the existing permit to <br />conduct coal mining and reclamation operations submitted by National King Coal <br />for the King Coal Mine. The revision provides for the addition of 240 acres <br />to the permit area and for rewriting the permit application. <br />The King Coal Mine operation is located in La Plata County, approximately <br />seven miles southwest of Hesperus, Colorado. The mine is an underground mine <br />with an anticipated maximum production capacity of 175,000 tons per year until <br />the year 2030, at which time production may increase to 250,000 tons per <br />year. The coal to be mined is federally owned, and the surface to be affected <br />is privately owned. The revised permit area encompasses approximately 1323.5 <br />acres in Sections 5 and 6, T34N, R11W; Sections 28, 29, 31 and 32, T35N, R11W; <br />and Section 36, T35N, R12W; all of the N.M.P.M. <br />This proposed approval decision is based on a finding that the proposed <br />operation will comply with all requirements of the Colorado Surface Coal <br />Mining Reclamation Act, C.R.S. 34-33-101, et sec., and the regulations <br />promulgated thereunder. <br />Copies of the proposed decision including stipulations, are on file for public <br />inspection at the Colorado Division of Minerals and Geology, Room 215, <br />Centennial Building, 1313 Sherman Street, Denver, Colorado 80203 and at the <br />County Clerk's Office in La Plata County, 1060 East Second Avenue, Durango, <br />Colorado. Persons with an interest that may be adversely affected by the <br />proposed decision may request a formal hearing before the Mined Land <br />Reclamation Board on the proposed decision. Such request must be made within <br />thirty (30> days of the initial publication of this notice, must be in <br />writing, and must state with reasonable specificity the reasons for the <br />request and the objections to the proposed decision. <br />
