Photographs of the relocated Bull Seep taken by UDFCD prior to May 5, 2001 indicate that the <br />relocated drainage channel is unstable, prone to bank erosion, and has not been built in accordance <br />with the designs provided in the approved drainage convol plan. Review of an aerial photograph of <br />the Howe Pit, Bull Seep Slough, and relocated Bull Seep taken on 2/26/01 indicates evidence of <br />erosional features and instability within [he relocated Bull Seep and also no evidence of an outlet <br />control structure at the point where the relocated Bull Seep discharges into [he Bull Seep Slough. Field <br />measurements taken by Allen Sorenson of the Division on October 16, 2001 indicate ..... unvegelated, <br />unstable cut banks and a channel capacity of ???? much less than the design capacity of »»». <br />9. 7/18/OI DMG sent a RTB letter to Western Mobile Concrete, Inc. (incorrect name of permitteej <br />scheduling a hearing for the August 22-23, 2001 Board Meeting. RTB sited a possible violation of C.R.S. <br />34-32.5-116(1) and the permit for failure [o perform the reclamation prescibed by the reclamation plan. <br />]0. 8/20/01 Jeff Schwarz of Massey, Semenoff, Schwarz, & Bailey, P.C. (representing the operator) sent a <br />request for the Division to renotice the RTB letter (to Mobile Premix Concrete) for the October Board <br />Meeting with [he understanding that the potential days of violation be calculated from [he Division's July 5, <br />2001 inspection [o the August 22, 2001 Board Meeting. <br />11.8/23/01 DMG sent 2"~ RTB letter to Mobile Premix Concrete for same citations as 7/I S/OI RTB and <br />scheduled operator for October 17, 2991 Board Meeting. <br />
