BEFORE THE MINED LAND RECLAMATION BOARD <br />STATE OF COLORADO <br />SCHEDULING ORDER <br />IN THE MATTER OF THE APPLICATION OF GCC RIO GRANDE, INC., FII.E NO. M-2002-004. <br />THIS MATTER came before the Mined Land Reclamation Board on June 26, 2002 at Denver, Colorado <br />for a decision on several requests from objectors to conduct an evening hearing on the captioned application. <br />The Division of Minerals and Geology has received an application for a limestone quarry from GCC Rio <br />Grande, Inc. The Division received 73 comments on this application, most of which aze objections. The Boazd, <br />having heard from the parties [o this case, and having been otherwise fully informed in the premises, makes the <br />following findings, conclusions and decision: <br />1. Several objectors requested that the hearing convene during the evening in order to accommodate their work <br />hours, or other possible commitments. <br />2. C.R.S. 34-32.5-115(2) and 24-4-105(4) authorize the Board to schedule the time and place for this hearing. <br />3. The Board customarily convenes in the mornings during its monthly meeting in order to ensure that there is <br />sufficient time to hear all matters that are scheduled each month. <br />4. The Board desires that each objector have a full and fair opportunity to present a case, and is aware of the <br />potential for conflicts between conducting personal and business affairs and attending these proceedings. <br />5. The objectors' interests in best accommodating these potential conflicts must be balanced with the Board's <br />statutory duty to heaz all cases in a timely and effective manner during its regularly scheduled monthly <br />meetings. The objectors in this case have raised numerous issues, requiring that the Boazd plan for a <br />hearing that is scheduled to last 7.5 hours. <br />6. The Board customarily has several other matters to hear each month, and schedules two days during which <br />these matters must be addressed. The Board is concerned that it must always be prepared to afford each and <br />every case the time and thought necessary to prepaze reasoned decisions. <br />7. In order that the issues raised by the objectors are afforded the attention they are due, it is important that the <br />Boazd conduct this proceeding at a time of day when the Board members aze most attentive, and that the <br />Board not unduly compromise its remaining agenda for the August meeting. <br />
