7. A portable rock crusher, a concrete plant, and an asphalt <br />plant are permitted with the condition that they shall be <br />restricted from locating within Phases VI, VII, VIII, IR, X, <br />Xi, and XII in order to maintain a reasonable distance ~~ <br />between portable facilities and the residential uses to the <br />south. <br />8, insurance - The operator shall furnish evidence he ie insured <br />to the extent of not leas than on hundred thousand Sollars <br />(5100,000.00) against liability for any negligent act or <br />omission by the operator from the operation or maintenance of <br />the sand and gravel pit, the extraction and production of <br />sand and gravel, and all activities connected with or <br />incidental thereto. ~ „ <br />9. The applicant shall obtain a N.P.D.E.S. Permit from the Water <br />Quality Control Division of the Colorado State Health <br />Department prior to discharge of any water into the Cache La <br />Poudre River. A copy of the N.P.D.E.S. Permit shall be <br />forwarded ko the Department of Planning Services. <br />10. There shall not be any dumping of any kind permitted within <br />the special vas Permit area either during extraction or <br />during reclamation. . <br />11. All operation on said described parcel shall be in <br />conformance with the Weld County Flood Hazard Overlay <br />Regulations including: <br />No fill, berms or stockpiles of sand and gravel shall be <br />placed in the floodway of the Cache La Poudxe River. <br />b. All fuel tanks, septic tanks, temporary buildings, and <br />other hazardous items that might wash away during <br />flooding shall be securely anchored and adequately <br />flood-proofed to avoid creation of a health hazard. <br />Following completion of mining, all temporary .buildings <br />shall be removed. <br />12. The applicant shall comply with the design standards for the <br />Oae by special Review, Section 24,5 et seq.r of the Weld <br />County zoning Ordinance. <br />I3. The applicant shall comply with the Operation Standards for <br />Uses by Special Review, Section 24.6 et eq. and section 44.4 <br />et seq., of the Weld County Zoning ordinance. <br />14.
